TERMS OF CARRIAGE

CONDITION One: Receipt and freight:

The sender of the parcel completes the accompanying document CN23, the Customs Declaration, states the date of shipment, the recipient and the contents of the shipment, which the carrier undertakes to transport and deliver to the consignee at the specified destination, subject to the rates and tariffs in effect on the date of shipment. Carriage charges are payable in advance.

CONDITION Two: Limitation of liability:

(a) The carrier is not liable for any loss, damage or harm arising from the following causes: acts of God, hostilities, riots, strikes, changes in legislation, nuclear contamination, radioactive contamination, epidemics.

(b) The amount of any loss for which the carrier is liable shall not exceed the lesser of USD 3.00 per kg or USD 60.00 per shipment, unless additional insurance has been purchased. In the case of additional insurance, the maximum amount of liability shall be confirmed by the value stated on the CN23 form, the Customs Declaration; in the event of any discrepancy, the value of the goods shall be confirmed by the sender, by store receipts and/or by references to the market value of the goods.

(c) Unless the parties have agreed otherwise in writing, the carrier is not liable for any special, indirect or other losses caused by any delay in the delivery of the cargo, regardless of the cause of the delay.

CONDITION Three: Notice of claim:

(a) No carrier shall be liable for the loss of or damage to any cargo carried under this contract unless notice of it, stating the details of the damage or loss and the estimated amount claimed in respect of such loss or damage, is provided in writing together with a copy of the CN23, the Customs Declaration, to the carrier within sixty (60) days after delivery of the goods or, in the case of non-delivery, within six (6) months from the date of shipment.

(b) The final claim statement must be submitted within six (6) months from the date of shipment together with a copy of the customer’s Customs Declaration.

CONDITION Four: Partial invalidity:

These terms, if they conflict with newly adopted laws, shall be invalid to the extent of that conflict, without voiding any other part of this document.

CONDITION Five: Amendment of the contract:

No agent, employee or representative of the carrier has the authority to change, modify or waive any provision of these terms.

CONDITION Six: Conditions for accepting a shipment on delivery:

The recipient of the shipment must inspect the contents of the parcel in the presence of the courier or the post office representative. In the event of damaged packaging or a weight discrepancy, a report must be drawn up and signed by the carrier’s representative and the recipient. Possible claims will be considered only on the basis of a written statement and the report drawn up, within 6 months from the date the shipment was sent.
